These are the requirements established after the passing of the Surrogacy (Regulation) Bill, 2016 in India. Now, only heterosexual couples who have been married to each other for at least 5 years and who have fertility issues that prevent them from achieving an ongoing pregnancy have the right to have a baby via surrogacy. The surrogate must be a family member who agrees to do it altruistically.
