In the Mexican state of Tabasco, surrogacy is permitted, whether gestational or traditional. However, if a traditional surrogacy is carried out, in which the surrogate provides the genetic load, she will be considered the legal mother of the child. In order for the intended mother to obtain the filiation of the minor, the surrogate mtoher must resign and, after that, the intended mother may proceed to initiate the adoption process.
In the second case, i.e. when a process of gestational surrogacy is carried out, in which the surrogate, here called gestational carrier, has no genetic link with the baby, the intended mother will automatically be considered the legal mother of the newborn.
