In order to be able to perform a surrogacy in Portugal, the parents and the surrogate mother must jointly request authorization to establish a contract for surrogacy.
To do so, they address their request to the CNPMA, the National Council for Assisted Reproduction, together with the necessary documentation:
- Identity documents
- Acceptance of the conditions foreseen by the contract
- Medical certificate
- Favorable psychological certificate
- Agreement of the center that will carry out the fertility treatment
The CNPMA has a maximum of 60 days to deliberate. In case of admission, it sends the file to the Order of Physicians who have a maximum period of 60 days to give their opinion. With the opinion of the Order of the Doctors, the CNPMA gives or not its consent so that the contract of surrogate gestation can be celebrated. The entire procedure can thus take up to 6 months.
