Portugal considers the possibility of using a surrogate as an exception. It is limited to women suffering from absence or dysfunction of the uterus. The diagnosis of infertility must be confirmed in an assisted reproduction center authorized by the Portuguese Ministry of Health.
This reproductive technique is applied to heterosexual couples and female homosexual couples, married or living together. Male homosexual couples, single men and single women are not eligible for treatment.
