In the Ukraine, gestational surrogacy is legal. However, it should be kept in mind that only heterosexual couples who are married to each other can have a baby through this technique. Moreover, it is necessary for the intended mother to have a medical cause that is preventing her from getting pregnant or carrying a pregnancy to term.

According to the U.S. Department of State (Bureau of Consular Affairs), as long as one intended parent is American, there will be no problem once the child is born and you apply for him or her to become a U.S. citizen.
