Surrogacy-friendly states without a law

In a great majority of US states, surrogacy is allowed with similar characteristics. The ones included in this group are favorable to surrogacy, but their statutes do not envisage surrogacy arrangements. In fact, Oregon and Rhode Island are commonly considered to be surrogacy-friendly, in spite of not having a law that explicitly allows surrogacy. However, case law indicates that they are favorable to this fertility treatment.

Other states included in this group are Alabama, North Carolina, South Carolina, Colorado, South Dakota, Georgia, Hawaii, Kansas, Kentucky, Maryland, Massachusetts, Minnesota, Misuri, New Mexico, Ohio, Oklahoma, Pennsylvania, Vermont, and Wisconsin.
